Individuals wishing to rent equipment are required to submit a minimum of a 50% non-refundable Booking Payment, a refundable damage/security deposit and may be asked to provide current, valid driver's license or state identification card.
A valid credit card will be required on file to secure the order as well as during the rental period.
All rentals are to be prepaid, unless a charge account has been previously established.
Open account customers in good standing may submit a signed purchase order in lieu of a security deposit.
A signed contract, or lack thereof, DOES NOT relieve you from personal, financial responsibility and obligation of payment for your reservation. It is implied that if a reservation is placed and a credit card number has been provided for securing the reservation with intent to take delivery of the goods, that you fully intend to take delivery of the goods. Only upon cancellation, which all cancellation terms of this agreement apply, may you relieve yourself of the financial obligation and responsibility to pay in full; unless your cancellation does not meet the requirements set forth in this agreement by which 100% of the payment shall apply. Such fees include but are not limited to: rental equipment fees, delivery fees, set-up fees, labor fees, damage waiver fees, administrative fees and any other fee associated with the special circumstances of your reservation.

Communication: All change orders must be approve with updated invoice and Change Addendum Contract via email. It is the Clients responsibility to provide accurate e-mail to SDE. It is the clients responsibility to notify SDE if emails are not being received. It is suggested to add

Final payment: If final payment has not been made 24 hours prior to reservation, SDE staff will place one (1) phone call in attempt to collect payment. If payment is not made at that point, the reservation will be canceled and all payments made will be forfeit.

Late Payment Fee: I am expected to pay the final due amount 14-7 days prior to taking delivery of the rental equipment. Failure to do so could result in the rental being cancelled. If SDE agrees to maintain the rental despite lack of payment, failure to pay in full within 30 days after delivery shall result in a 15% late fee. This fee is assessed on the total contract amount including all related delivery fees and other expenses. For each 30 net days beyond your initial 30 day period, a compounded 15% rate shall apply for each additional 30 day period. There is no cap to the amount of compounded late fees that apply to your delinquent account.

CANCELLATIONS: Due to the high demand for equipment, it is necessary for SDE to have reservations guaranteed in advance in the form of a Booking Payment. All fees paid are non- refundable and and once Booking payment has been remitted I am agreeing to pay the full balance of the rental order. Cancellations are not allowed once original deposit has been paid. If I need to cancel with more than 4 weeks, my deposit may be applied to another date within 365 days, if a date is available once. Change fee may apply. Rental reservations closer than 4 weeks cannot be cancelled or postponed . (I may ask SDE not to deliver, but I am still responsible for the full rental fee). Any fees incurred while planning in good faith, are non-refundable. Once an item has been held for me, it appears unavailable for other future clients. I may choose to reserve the fewest number of items for my event, hoping to add to the order closer to the date. But I risk the items being rented to other clients and not available.

SPECIAL ORDERS ( if applicable): Payment in full is due at the time of reservation for any special order items. This included A Grade quality items. I will be notified if items are indicated as special order. As shipping may take 4 weeks to 6 months, SDE will order Special Order items once payment has been remitted. SDE will not be held responsible if the items have not arrived for your event.

Delivery (if applicable): Delivery is to the parking lot only. If there is a gate code, pad lock, or business hours that may be closed, or other circumstance that would hinder SDE's ability to deliver or pick rental items up, it is imperative I will notify SDE office staff well in advance to arrange accommodations. If SDE crew is unable to deliver to the parking lot, the client will incur additional fees including but not limited to standing fees, additional delivery charges, or cancelled reservation.

Should delivery and/or set up (if applicable) be deemed non standard due to outside forces, including by not limited to space, distance from truck, weather (abnormal wind or rain), terrain or topography, I understand that there may be extra fees including standing fees while feasibility is determined or alternatives are found.

SDE will secure any rental tents with stakes (if applicable) around the perimeter of the tents, unless prior accommodations have been made. Asphalt plugs are available for extra upon prior request . It is the clients responsibility to provide markings on the ground of buried hazards including, but not limited to, septic systems, sprinklers, utilities prior to our arrival. If SDE crew is withheld due to unclear areas for securing the tent, standing fees may be assessed. Weighted blocks are available upon request for extra if available and may require additional delivery charges.

Weather: SDE will do its best to deliver and set up (if applicable)all equipment as contracted. However, due to extreme foul weather considerations. SDE reserve the right to refuse release of rentals or set up of equipment if the weather is deemed unsafe at SDE discretion. SDE staff will communicate with the client to discuss foul weather options. Options may include moving rentals indoor or scheduling return set up time if weather looks to be clearing, extra fees may apply. Further, if the weather is unsafe to tear large equipment down at scheduled appointment we reserve the right to return when weather is deemed safe again. SDE staff will communicate with the client ahead of tear down should weather be an issue. No refunds will be made for weather related cancelations.

I have allowed Sunny Days Events to act as my contractor to set-up (if applicable), connect, display and begin operation of all rental equipment and will not hold Sunny Days Events responsible for any incorrectness or negligence as a result. Sunny Days Events will set up equipment to "The best of their ability" and are not and should not be considered experts in the construction, operation, placement or display of any rental equipment.

Standing Fee: I will be given a delivery & pick up window and a 15 to 30 minute curtesy text for the delivery. Standing Fees are $2.00 per crew per minute. If my representative is not present when SDE staff arrive standing fees will still apply. SDE may begin set up upon arrive with prior notice and IF an SDE approved layout has been provided with adequate notice to

. However, once SDE staff begin set up, should the client or approved client representative choose to make changes extra fees may apply. IF SDE crew is forced to wait or clean up (if not contracted to do so) a standing fee may be assessed at the discretion of SDE. If the delay creates a circumstance where the items are needed for another event and are not made available to that customer due to the clients lack of planning, then SDE will charge TEN TIMES the rental rate for each item that is made unavailable. *

The following conditions regarding specific equipment shall be agreed upon and any action not in strict adherence to the guidelines below shall result in FULL REPLACEMENT VALUE of each damaged item: o Dance Floors: Dance floors shall only be placed on a flat, hard surface free of debris such as gravel, rock, dirt or any other hard substance that may scratch or otherwise cause abnormal wear on the surface. The dance floor shall be placed in a location away from water hazards such as pools or sprinklers. The dance floor must be completely covered and secured from any water invasion or completely removed from the area and stored in a dry location. It is the RENTER'S responsibility to take such action. Any water damage to the dance floor will result in a full replacement charge for each damaged panel. o Tents and Umbrellas: All tents and umbrellas are subject to wind hazards, should wind and weather be deemed unsafe for set-up. SDE staff will coordinate with the client about options for back up plans. It is YOUR responsibility to secure items in windy conditions where a possible threat of damage may occur. On occasion, smaller canopies and umbrellas that are not secured to any ground weight or stake and may blow over causing damage to the equipment or injury to a person. Because Sunny Days Events cannot be at your location at all times, YOU are responsible for the liability for the duration of your rental. Once secured, all tents and canopies may not be moved or removed from the location in which it was placed by an employee of Sunny Days Events, nor shall you alter or modify the form in which the equipment was secured. Doing so violates the terms and conditions of this agreement and any damage or injury as a result shall be your responsibility. The only exception to this condition is for complete removal and take-down of Non-Tent items after an event or in the event of an emergency.

Inspection: I understand that I, or my Pre-Authorized Representative, will be given full and ample opportunity to inspect all rental equipment at the time of delivery and find no obvious damage. At the time of delivery I, or my Pre-Authorize Representative, will notify SDE staff immediately and allow SDE to rectify any issues identified. Any issues brought to SDE’s attention after the original delivery will not be recognized. Misuse or improper operation of equipment which results in any injury, damage, personal loss or Death as a result of my or my guests' misuse or negligence is NOT the responsibility of Sunny Days Events.

Event Insurance: I am aware that it is in my best interest to obtain private event insurance for the entire rental period. I will accept full responsibility for any weather cancellation, accident, loss, damage, injury, theft, loss of limb, death or any other conceivable misfortune or accident that may occur as a result of the use, operation, transport or ingestion by myself or any of my guests.

I understand that negligence on my part or the part of my guests in regards to operation or use of rental equipment does not constitute negligence on the part of Sunny Days Events and will not hold Sunny Days Events responsible for any injury, damage, personal loss or death as a result of my or my guests' negligence.

I am responsible for the safety, storage, preparation, cleanliness and correct operation of all rental equipment, accessories and food items associated with the rental equipment.

Cleaning /Damage: I am responsible for the equipment from the time the equipment is delivered and set up to the time it is picked up. I will ensure rental equipment is secured when not in use and protected from wind and water hazards such as inclement weather, outdoor sprinklers, pools, pets or wet or damp surfaces. I will be charged up to full replacement including shipping cost for any damaged or missing items. I will be charged a cleaning fee if the equipment is returned dirty beyond normal use. It is the client's responsibility to clean all items rented, this includes rinsing/scraping silverware, place settings, chairs and tables including removing any staples, tape and gum from the bottom of the tables. Others items that are damaged may cost more to repair / replace those items include but are not limited to: Tents, Tables, Chairs, Dance Floors, Linens, Dishware, Flatware, Audio Visual Equipment, Concession Equipment, Bars, and Themed Rentals.

Holiday: Events falling on a holiday or holiday weekend may be subject to Holiday Charge. Holidays included in this list include but are not limited to Valentine's Day , Easter Sunday (and the week prior), Memorial Day, Independence Day (July 3, 4), Labor Day, Halloween, Thanksgiving, Christmas (December 24, 25), New Years (December 31, January 1)

Overtime: Should a rental pick up/delivery be scheduled or be delayed past standard operating hours through no fault of SDE overtime fees may be applied.

Sunny Days Events reserves the right to refuse rental and service to anyone. By signing this contract the client is committing and agreeing to all of the terms and conditions of this agreement. Should Sunny Days Events agree to fulfill a rental without a signed contract, it is implied that by receipt of a confirmation email or confirmation by written, verbal or any other source that you have read, fully understand and commit to the terms and conditions of this agreement.

If SDE is forced to take legal action to recover SDE equipment, I agree to pay for any and all legal fees. Additionally, SDE retain the right to charge for loss of use for the time the equipment is not in SDE possession.
